Both attorneys and advocates support families in securing appropriate educational services for children with disabilities. Advocates guide parents through the educational system, help develop goals, services, and accommodations, attend school meetings, and communicate with school staff to ensure the child’s needs are met. While they provide valuable support, advocates cannot offer legal advice or services.
Special education attorneys can do everything an advocate does but also provide legal expertise. They interpret education laws like the Individuals with Disabilities Education Act (IDEA), represent families in disputes or due process hearings, negotiate settlements, and ensure schools comply with legal requirements. If a situation escalates beyond advocacy, an attorney can take legal action to protect the student’s right to a Free and Appropriate Public Education (FAPE).
